Please read carefully the following terms and conditions for the website whose URL is www. paulineuk.org (“Site”). You can print off these Terms, or store them in your computer, for future reference.

Pauline Books & Media is a not-for-profit organisation.  Its main objective is to communicate the Good News of Jesus Christ to the world with the media of social communication.

 

Use of the Site constitutes acceptance of these Terms.

LEGAL INFORMATION


1.1 Applicable Law

The content of this Site and  any contracts formed between The Pious Society of the Daughters of St Paul (“we”, “us” or “our”) and a user (“you”  “your” or “user”) as a result of using this  Site shall be governed in all respects by English law and each party hereby submits to the non-exclusive jurisdiction of the English courts.

 

1.2 Intellectual Property

The Site’s design and content, including the Pauline logo are the property of The Pious Society of the Daughters of St Paul, or have been licensed to us, and are protected by all applicable trademark, copyright and intellectual property laws and conventions as detailed in our Copyright and Trade Mark Notice. Permission to reproduce, download, adapt, alter, modify, rent, lease, loan, sell, distribute or create derivative works of any content of the Site, or of any Site property received by you as part of an order, in whole or in part, other than for the sole purpose of placing an order with us, without the prior written permission of The Pious Society of the Daughters of St Paul, is strictly prohibited. All rights reserved.

1.3 Dealings with Third Parties

1.3.1 Third-party websites granted permission in accordance with clause1.2 must ensure that the content is presented in its original form. We retain the right to withdraw permission where previously granted if content is used in a defamatory, abusive or derogatory manner.

 

1.3.2 The Site, or third parties may provide links to other web sites or resources, promotions of advertisers and merchants. As we have no control over such sites, third party resources and material, you acknowledge that we are not responsible for the availability of such external sites, third party resources or the content of such material, do not endorse and are not liable for any content, advertising, products, services or other materials on or available from such sites, third party resources or contained in such material.

 

1.3.3 Any dealings by you with any third party on or through the Site shall be solely between you and that third party and we shall not be responsible for any loss or damage that may arise from any such dealings, nor shall we be deemed to be acting as an agent for you in any such dealings.

 

1.3.4 It is sometimes possible to access this Site through a link located on another web site or within a third party email communication. We do not make any representations, or endorse any products, materials, companies or individuals that provide a link to this Site or make any warranties with respect to any information contained in or at these other sites or third party communications.


1.4 Disclaimers
1.4.1 Every effort is made to ensure these Terms remain up-to-date. However, we reserve the right to amend these Terms at any time and without prior notice. Your continued use of the site following changes to these Terms will be deemed to be your acceptance of those changes.

 

1.4.2 We retain the right to refuse to enter into a contract for the  provision of goods and services if we have cause to believe that a user’s conduct is in breach of these Terms  or any applicable law, or if the user’s conduct runs contrary to the interests of The Pious Society of the Daughters of St Paul. The user’s statutory rights are not affected.

 

1.4.3 Price and product availability are for information purposes only. We reserve the right to change price and product availability at any time without notice. We sell our products through a number of online channels and we reserve the right not to sell at a price listed on a site other than our own.

1.4.4 We cannot accept any responsibility for any loss, disruption or damage to your data or your computer system that may arise from use of this Site, nor can we be held liable for the Site being temporarily unavailable due to technical or other reasons.


1.4.5 Pauline Books & Media exercises great care over the editorial aspect of the Site. We are concerned that its content always reflect the Gospel’s respect for the dignity of the human person, whatever his or her race, language, religion, age, social condition or state of mental, emotional and physical well-being. Should you find any offensive or defamatory material on the Site, we ask that you notify us immediately.

 

1.4.6 Our trading name and the Site are owned by us and are descriptive of our products and services.

 

1.4.7 Your use of the Site is at your sole risk. The Site is provided on an “as is” and “as available” basis and we do not guarantee that the Site will be suitable for your purposes or requirements. If your PC does not support relevant technology, including encryption, you may not be able to use certain services or access information on the Site.

 

1.4.8 The Site is accessed via the World Wide Web which is independent of us. Your use of the World Wide Web is solely at your own risk and subject to all applicable national and international laws and regulations. We do not represent that the Site is appropriate or available for use in any jurisdiction other than the United Kingdom. We shall have no responsibility for any information or service obtained by you on the World Wide Web.

 

1.4.9 The content of the Site has been compiled from a variety of sources and is subject to change without notice. We use reasonable care in compiling and presenting the content of the Site, but we give no guarantee that the content is complete, accurate, error or virus free or up to date.

 

1.4.10 We do not assume any liability, or responsibility, for any content uploaded or otherwise transmitted by you or any third party to the Site.

 

1.4.11 So far as permitted by law, we disclaim all warranties, conditions and other terms of any kind, whether expressed or implied, whether in contract, tort (including liability for negligence),  or otherwise, including, but not limited to any implied term of satisfactory quality, fitness for a particular purpose, and any standard of reasonable care and skill. 

 

1.5 Limitation of Liability

1.5.1 So far as permitted by law, and except in respect of death or personal injury arising from negligence, we exclude any liability for loss or damage of any kind resulting from the use of the Site (including the reliance upon any information contained on it).

 

1.5.2 We shall not under any circumstances be liable for any special or consequential damages that result from the use of, or the inability to use, the materials in this Site, even if we or a representative of ours has been advised of the possibility of such damages.

 

1.6 Indemnity

1.6.1 You agree to indemnify and hold us and our [trustees, employees, assignees and licensees harmless from and against any and all claims, damages, liabilities, costs and expenses, including reasonable attorneys’ fees, arising from any breach of your obligations under these Terms.

 

1.7 General Information

1.7.1 These Terms constitute the entire agreement between you and us.  If any of them are held by a court of law to be illegal or otherwise unenforceable by the laws of any state or country, then to the extent that any term(s) is (are) illegal or unenforceable, they shall be deleted from these Terms and the remaining terms shall survive and remain in full force and effect.

 

1.7.2 Any failure by us to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.

 

PRIVACY & SECURITY

2.1 Policy Scope
2.1.1 The data controller is Pauline Books & Media (referred to in this policy as “we” or “us”).

2.1.2 This privacy and security policy (this “Policy”) sets out the types of personal data that we collect, explains how and why we collect and use your personal data, explains when and why we share personal data with other organisations and explains the rights you have in respect of your personal data.

2.1.3 This Policy applies to you if you use our services (referred to in this Policy as “our Services”). Using our Services means shopping with us by telephone, by post, by email or online. This Policy also applies if you contact us or we contact you about our Services. Parts of this Policy also apply to our centre and Head Office CCTV systems.

2.1.4 Our website may contain links to websites managed by other organisations. Pauline Books & Media does not endorse the content of any third party website. We do not accept any responsibility for the data protection policies governing such websites, nor do we accept any liability arising from the use of third party websites.

 

2.2. Personal Data We Collect
2.2.1 When you register for our Services, you may provide us with your personal details, including your title, job title, phone number, email address and postal address and your account password.

2.2.2 When you shop with us online or browse our website, we may collect information about your online browsing behaviour, information about your online purchases, information about any devices you have used to access our Services (see ‘Cookies’), information about website traffic and website usage.

2.2.3 When we contact you or you contact us or you take part in surveys, we may collect personal data you provide about yourself. This may be by telephone, email or post or when you contact us through social media.

2.2.4 When you visit our centres or Head Office, footage of you may be recorded on our CCTV systems.

2.2.5 We may also use personal data from other sources, such as public registers in order to improve the accuracy of the data we hold.

 

2.3. How and Why We Use Personal Data

2.3.1 We use personal data to:

  1. Manage the account you hold with us. We need to process your personal data so that we can manage your customer account, payments and refunds and the delivery of goods.
  2. Manage our website. We use cookies to improve your customer experience (see ‘Cookies’).
  3. Personalise your shopping experience. Analysing your browsing behaviour helps us to tailor marketing communications to your interests or requirements.
  4. Communicate with you about our Services. We use personal data to communicate with you, including inviting you to take part in customer surveys.
  5. Prevent and detect crime in order to protect the sisters, lay staff and members of the wider community.
  6. Resolve disputes. We use personal data in addressing legal claims or disputes and may be required to divulge personal data to third parties in such circumstances (see ‘Sharing personal data with other organisations’).

 

2.4. Lawful Basis

2.4.1 In relation to ‘How and Why We Use Personal Data’, the lawful bases for processing your personal data are:

  1. Manage the account you hold with us: processing is necessary for a contract or legitimate interests.
  2. Manage our website: legitimate interests.
  3. Personalise your shopping experience: legitimate interests.
  4. Communicate with you about our Services: legitimate interests or consent.
  5. Prevent and detect crime: legitimate interests.
  6. Resolve disputes: legitimate interests or legal obligation.

 

2.5. Sharing Personal Data with Other Organisations

2.5.1 We will not sell, rent or disclose personal data we hold about you without your consent unless required to do so in the following circumstances:

2.5.2 The personal data that we collect from you will not be transferred to, or stored at, a location outside the European Economic Area.

2.5.3 We may provide aggregated data to a reputable third party; whenever we do so such data is anonymised.


2.2.6. How We Protect Personal Data
2.2.6.1 Pauline Books & Media takes the following measures to protect personal data:

2.6.2 Whilst we take appropriate technical and procedural measures to safeguard your personal data, it is important that you keep your account and password details and devices protected from unauthorised access. Whilst the website uses encryption and secure (SSL) servers to help ensure the privacy of information that you provide, the security of information and payments transmitted over the internet cannot be guaranteed. Pauline Books & Media shall not be held liable for any losses incurred or sustained by users who transmit information by means of email, to third party websites or over unsecured networks and in no event shall any such losses in whole or in part by borne by Pauline Books & Media.

 

2.7. Data Retention

7.1 We will not keep your personal data for longer than is necessary. The length of time depends on why we collected it, how old it is, whether there is a legal requirement for us to retain it and whether we need it to protect you or us.

 

2.8. Marketing and Mailing Lists

8.1 We will send you relevant offers, updates and notification of events by email, but only if you have previously provided consent to receive such communications. When you subscribe to a mailing list you will be asked to consent to our using the data you provide and you will be asked to provide such information as is necessary for us to tailor the communications we send to your interests or requirements.

8.2 If you have opted to receive notification of offers, updates and events, we may use the details you provide to contact you by telephone, post or email. You may update your communication preferences at any time in writing, online or by clicking on the ‘Unsubscribe’ link in any email communication you receive from us. Alternatively, if at any time you wish to stop receiving the newsletter, please email newsletter@pauline-uk.org.

 

2.9. Updating Your Personal Data

2.9.1 If you wish to update the personal data you have provided please do so either online or by notifying customerservice@pauline-uk.org.

 

2.10. Cookies

2.10.1 Cookies enhance the user experience and permit us to collect information on visitors to our website. Cookies are small text files we use to identify users which also allow us to observe user behaviour and compile aggregate data in order to develop website content and improve the marketing of our products.

2.10.2 We use cookies to collect the following information: the IP address of the user’s device and network, the date and time the user visited the website, the page(s) visited and, if applicable, the website or page that linked to such page(s) (such as a search engine).

2.10.3 If you do not wish to receive cookies from us or any other website, you may choose to disable cookies in your browser. If you do so, some parts of the website may not function properly. Please refer to your browser help function. We cannot accept liability for any malfunctioning of your device or its web browser as a result of disabling or attempting to disable cookies.

2.11. Subject Access Rights

11.1 You have the right to obtain the personal data we hold about you. This is called a Subject Access Request. If you would like a copy of the personal data we hold about you, please write to us, or email customerservice@pauline-uk.org.


2.12. Other Data Protection Rights

2.12.1 As a data subject you have various rights including the right to have inaccurate personal data corrected, have us delete it, and the right to complain to the data protection regulator (the ICO). The ICO website provides detailed guidance on these rights.


2.13. Amendments to this Policy

13.1 We reserve the right to modify this Policy, such changes being effective immediately. By continuing to use the website, you will be deemed to have accepted any such changes. Last update: 23 May 2018.

 

TERMS AND CONDITIONS OF SALE

 

3.1 Contract Formation

3.1.1 These Terms apply to the sale of all goods online to consumers.  For all pre- and post-sale enquiries, please contact customerservice@pauline-uk.org.

 

3.1.2 No contract shall exist between you and us for the sale of any goods until we accept an automated e-mail, confirming receipt and acceptance of the order.

 

3.1.3 By placing an order for any goods with age restrictions, you declare that you are age eighteen or over in order to purchase the goods.

 

3.1.4 The price, delivery charges and description of the goods are displayed on the Site.  Such information is subject to change without notice.

 

3.1.5 Subject to clauses 3.1.2 and 3.1.7, the price you shall pay for the goods is the price displayed on the Site at the time we receive your order.  You may choose to pay by any method specified on our website. By authorising payment and submitting your order on the checkout screen, you are agreeing to purchase goods or services at the price stated and subject to our terms and conditions.

 

3.1.6 Except where stated otherwise, all prices are shown in pounds sterling and, where indicated, are subject to VAT. Pauline Books & Media is not responsible for currency conversion rates or charges applied by the purchaser’s card issuing company.

 

3.1.7 If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible.  In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price.  We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price.  We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order altogether.  If you cancel and have already paid for the goods in the circumstances described in this clause, we shall refund the full amount in accordance with these Terms. 

 

3.1.8 You shall be required to pay an additional charge for delivery, the amount of which shall vary according to the particular goods and the delivery method that you choose.  The type of charge payable will appear on the Site.

 

3.1.9 Further details about the goods and advice or recommendations about their storage, application or use, which are not given on the Site, may be made available on request, but should only be relied upon if confirmed in writing.  Alternatively, please see the manufacturer, author, artist or distributor’s website.

 

3.1.10 We endeavour to ensure that all of the items shown on the Site are accurately represented.  There may, however, be some slight variations (and this should be expected) between what you see and what you receive in any order, which you agree to accept, provided the variations are not substantial.  We may correct any typographical or other errors or omissions in any catalogue, sales literature, quotation or other document relating to the sale of the goods without any liability to you.

 

3.1.11 We may also at any time, without notifying you in advance, make any changes to the goods or their specification which are necessary to comply with applicable safety or other statutory requirements, or which do not materially affect their quality or performance. 

 

3.1.12 We will take all reasonable precautions to keep the details of your order and payment secure by using a third party payment provider whom we understand uses industry standard Secure Sockets Layer (SSL) encryption technology, making our pages secure.  Accordingly, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to your information, either on our Site or our payment provider’s.

 

3.1.13 The price of the goods is payable in full on or before delivery.  Receipts for payment will be issued automatically by email for any purchases made online from the Site.  If the goods are not paid for in full on or before delivery, they shall remain our property until payment is received from you.

 

3.1. 14 For non-account holders, products are only dispatched once payment has been authorised by the user’s card issuing company. For online orders, Pauline Books & Media accepts payment by credit or debit card. In the rare event of items charged for, or invoiced, being out of stock, we will inform you and either arrange for such items to be despatched as soon as they become available or issue a refund or credit note in respect of such items.


3.1.15 Pauline Books & Media reserves the right to postpone or cancel despatch of your order if one or more of the goods ordered has been listed at an incorrect price due to a typographical error, or an error in the pricing information received by us from our suppliers.

 

3.1.16 Users are responsible for notifying Pauline Books & Media where goods have not been received within seven days of despatch.

 

3.2 Availability

3.2.1 All products and services advertised on the Site are strictly subject to availability.

 

3.2.2 If we have insufficient stock to deliver the goods ordered by you, we will inform you of this as soon as possible and give you the option of providing you with substitute goods of equivalent quality and price.  If you choose to receive the substitute goods, and later chose to return them, we shall pay for the return of such goods.  If you have already paid for the goods and choose not to receive substitute goods, a full refund will be made as soon as possible and in any event within thirty days, commencing on the day on which your notice of cancellation was given.

 

3.3 Delivery

3.3.1 Delivery will be made as soon as possible after your order has been accepted, and in any event within thirty days of your order.  If we are unable to deliver the goods within thirty days of your order, we will inform you as soon as possible and you will be entitled to cancel the order and obtain a refund or credit note for any sum that has been paid by you or debited from your credit card for the goods.  We will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.

 

3.3.2 We will deliver the goods ordered to the address given by you for delivery at the time you place the order.  If there is no-one at the address given who is competent to accept delivery of the goods, you will be notified of an alternative delivery date or a place to collect the goods.

 

3.3.3 We will bear the risk of the goods damaged whilst in transit.  Responsibility for loss of, or damage to, the goods passes to you upon delivery, whether or not the goods have been paid for in full.

 

3.3.4 If the goods have been paid for in full, transfer of ownership occurs upon their being received by you.

 

3.4 Postage and packing

3.4.1 Postage and packing charges are subject to the advertised rates.

EU £15.00 + £1.00/item*

Rest of the World £25.00 + £2.00/item*

 

*Rest of the World: You may contact Pauline Books & Media centre nearest to you to minimise the postage cost.

3.4.2 Where all items ordered are in stock and payment has been authorised, Pauline Books & Media aims to dispatch all such orders within forty-eight hours of receipt.

 

3.4.3 Goods are dispatched in accordance with the terms and conditions of the carrier.

 

3.5 Discounts & Special Offers
Pauline Books & Media offers two types of discount to account holders: a school discount and a trade discount. Schools and trade customer accounts are available on request; please contact us if you wish to open such an account. These accounts are available entirely at the discretion of Pauline Books & Media and may be withdrawn at any time. Credit references may be requested.

 

3.5.1 Schools. We offer 10% discount to schools on all Pauline UK products. For offline orders we also offer discounts on Bibles and other books which are purchased in quantity. School orders must be accompanied by an official purchase order on headed notepaper (via email) with the contact details of the person responsible for authorising payment.

 

3.5.2 Special Offers. Pauline Books & Media runs special offers from time to time to encourage the sale and distribution of our products and services. Special offers may not be applied retrospectively to orders placed previously and web-specific offers cannot be applied to offline purchases. Special offers cannot be honoured after the expiry date specified. Special offers may not be taken in conjunction with any other offer or discount provided. Pauline Books & Media reserves the right to withdraw special offers at any time and without notice.

 

3.6 Returns & Refunds

3.6.1 Pauline Books & Media will refund, replace or issue a credit note for all damaged or faulty goods, including original and return postage costs, subject to clause 3.6.3, provided notification.  Despatch of replacement goods or the processing of a refund or credit note will take place once the goods have been returned and checked. 

3.6.2 If the user is not completely satisfied with the goods received for any reason, other than being damaged or faulty, or failed to cancel and order in accordance with clause 3.7 the user must submit a request to return the goods within the time period stipulated in clause 3.6.1. In all instances, the user is responsible for the cost of return postage.

 

3.6.3 In the rare instance that the return is due to an order processing error on the part of Pauline Books & Media, we will refund or issue a credit note for an amount including original and return postage costs.  Where the user is entitled to a refund or credit note in respect of original postage costs, we will only refund the standard delivery cost, even if a more expensive alternative was selected.

 

3.6.4 We reserve the right to charge a handling fee of 50% of the value of the goods where the goods have not been kept in a reasonable condition, have been used and/or not been packaged properly by the user, prior to return.

 

3.7 Cancellation

You have the right to cancel an order within twenty-four hours of having placed it.  In such circumstances a refund or credit note will be issued.  An order may not be cancelled after twenty-four hours of it having been placed.

 

3.8 VAT, Customs Duty and Import Taxes

3.8.1 VAT is applied to non-book materials and some mixed supplies (such as a single item comprising a book and a CD or DVD) delivered to European Union customers who are not VAT-registered. If you are resident in the EU and are registered for VAT purposes, you are responsible for notifying Pauline Books & Media of your VAT registration number. VAT is not chargeable to customers outside the European Union.

 

3.8.2 Where Pauline Books & Media  acts as an intermediate supplier in the importation of goods for direct despatch to a UK customer’s address, you hereby authorise Pauline Books & Media to recharge to you all import duties and taxes incurred in the import of such items, and account for VAT according to the rules governing such transactions, where applicable.

 

3.8.3 If you are ordering goods for delivery outside of the EU, note that your consignment may be subject to import duties and taxes. Any such charges levied in relation to customs clearance must be borne by you. We recommend that you check with your local customs office for more information regarding importation duties and taxes.

 

3.9 Force Majeure

We shall not be liable to you for any failure to deliver the goods that have been ordered by you or any delay, damage or defect to the goods delivered which is caused by any event or circumstance beyond our reasonable control.
